Federal judge blocks HHS from cutting billions in funding to states

A federal judge in Rhode Island will temporarily block President Donald Trump’s administration from cutting $11 billion in public health grants to the states.

U.S. District Court judge Mary McElroy said the plaintiffs — representing 24 states and the District of Columbia, including Colorado — were likely to prevail in a lawsuit filed last week seeking to restore funding that was rescinded in March and indicated that she will grant a temporary restraining order.

“They make a case, a strong case, for the fact that they will succeed on the merits, so I’m going to grant the temporary restraining order,” McElroy said Thursday.

Colorado Attorney General Phil Weiser joined a coalition of 23 states and the District of Columbia in filing a lawsuit against the U.S. Department of Health and Human Services and HHS Secretary Robert F. Kennedy, Jr., for terminating the grants. Colorado could lose more than $229 million from the HHS cancellations. 

“America just went through a pandemic — one that erased jobs throughout the country, upended our lives, and caused the deaths of thousands of Coloradans,” Weiser said in a press release announcing the lawsuit. “The public health impacts of that pandemic continue to linger, including mental health and substance abuse challenges. This action of Secretary Kennedy to defund committed grants for public health and behavioral health purposes is inexplicable, illegal, and will cause untold damage to Colorado.”

In the lawsuit filed in U.S. District Court in Rhode Island, the coalition of attorneys general assert that the mass terminations violate federal law because the end of the pandemic is not a “for cause” basis for ending the grants.
