Weld court dismisses one part of cases between trucking companies

KERSEY — A dispute between two trucking companies in the 34 Transportation Center east of Greeley in Kersey continues to make its way through court, with the court dismissing one claim for relief while another awaits either dismissal or trial.

The case is between Texas-based Peterbilt truck seller Rush Truck Centers of Colorado Inc. and Weld County resident and developer Craig Sparrow, along with the 34 Transportation Center Association, an organization that Sparrow controls.

Rush contends that Sparrow has harassed the Peterbilt dealership, made bogus environmental claims, stacked the board of the transportation association to favor his position and levied expenses and liens against it.

Sparrow said in court filings that he witnessed dumping of oil and grease in violation of environmental laws, that the truck dealership operates in violation of the association rules and has been unresponsive to demands that operational changes be made.

Rush filed its lawsuit in April and sought relief from Sparrow’s actions and an order removing him from his role as a director for “gross abuse of authority.”

This week, the court denied the motion to remove Sparrow and dismissed that part of the case as it applies to both Sparrow and the transportation association.

A decision on other allegations remains to be determined.

The case is Rush Truck Centers of Colorado Inc. v. Craig Sparrow and 34 Transportation Center Association, case number 2023cv30251 in Weld County District Court.
