Colorado House approves construction-defects bill

A bill aimed at solving Colorado’s deficit in condominium construction received unanimous approval in the state House of Representatives Monday.

The Denver Business Journal reports that House Bill 1279, sponsored by Rep. Alec Garnett, D-Denver, and Rep. Lori Saint, R-Dacono, now goes to the Senate. The bill requires that a majority of condominium owners in a unit vote to proceed with any construction-defects litigation before a lawsuit can be filed. Current law allows lawsuits to proceed with with approval of the board of a homeowners association.

Colorado’s construction-defects law has been blamed for a lack of significant condo construction, with condos’ share of new housing plummeting from more than 20 percent a few years ago to about 3 percent.
