Xcel gains boost from Colorado appeals court in Boulder’s municipalization quest

Xcel’s lawsuit seeking to squash the city of Boulder’s creation of a municipal electric utility got new life from the Colorado Court of Appeals on Thursday.

The Camera reports that the appeals court reversed a ruling from last year by a Boulder District Court judge to dismiss the suit.

The development comes at a time when the city and Xcel have been negotiating a settlement that would end Boulder’s municipalization efforts but also a time when the city is getting ready to submit a revised application to separate from Xcel with the Colorado Public Utilities Commission.
