Loveland City Council passes construction-defects reforms

Add Loveland as the latest in a string of Colorado cities to approve its own construction defects reform while lawmakers at the state level struggle to do the same.

The Reporter-Herald reports that City Council voted 7-1 on Tuesday night to approve on second reading an ordinance that it hopes will help provide more affordable housing by spurring construction of condominiums. Specifically, the ordinance does things like give builders the right to repair defects with a homeowner’s consent and require HOA boards to “receive majority consent of owners before making claims against builders and developers.”

Opponents of Colorado’s construction-defects laws have argued that the state statutes make it too easy for homeowners to sue developers and contractors for faulty building, which has nearly eliminated new condo construction. Denver, Lakewood and Aurora have all passed reforms related to the laws.
