PUC decision provides Boulder path for municipalization

BOULDER — The Colorado Public Utilities Commission has issued its written decision on Boulder’s municipalization plan, which provides the city a path forward in creating its own electric utility.
Boulder can acquire certain distribution assets located outside of substations owned and operated by Xcel Energy, according to the decision. There are three conditions that Boulder must meet if it wants to go to condemnation court to value and acquire those assets. Those conditions are:
- the filing of an agreement between Boulder and Xcel providing permanent rights to Xcel to place facilities in Boulder so it can continue to serve its customers
