Carriers can continue non-ACA compliant plans

DENVER – The Colorado Division of Insurance said Friday it will allow insurance carriers to continue through 2015 health-insurance plans that are not compliant with the Affordable Care Act rules that went into effect Jan. 1.

The decision is in line with President Barack Obama’s announcement in March that such plans should be allowed to continue, according to a prepared statement.

Continuing these plans into next year means that consumers who renewed individual or small-group plans in 2013 may be able to renew these plans in 2014 for continuation into 2015, if their carriers continue offering the plans, according to the Division of Insurance.

Carriers will not be allowed to reinstate plans discontinued in 2013, and new plans that do not comply with the Affordable Care Act will not be allowed.

New legislation is not needed to make this change, according to the release. The Colorado Legislature passed a bill last year called the “alignment bill,” which enables the Division of Insurance to regulate insurers in alignment with federal guidance given on the Affordable Care Act.
