Contractor sues to seek payment for Smucker’s Longmont facility construction

GREELEY — A Colorado subcontractor that did work on the JM Smucker LLC food production plant outside Longmont in Weld County has filed a lawsuit seeking payment for what it says are $329,662 in unpaid bills.

The company, Colorado Designscapes Inc. of Centennial, filed the lawsuit against JM Smucker LLC, based in Ohio, and The Dennis Engineering Group LLC based in Springfield, Massachusetts. Dennis was described as the prime contractor on the construction of the production plant at Longmont.

The plant, a 432,000-square-foot facility that produces the Uncrustables frozen sandwich line for Smucker, won Food Engineering’s 2020 Food Plant of the Year Award.

Neither Smucker nor Dennis Engineering returned calls or emails requesting comment on the lawsuit.

Colorado Designscapes claims through its attorneys, Moye White LLP, that it performed work and provided equipment and materials in the construction of the plant and that under its contract it was due an additional $329,622. It filed a lien with the Weld clerk and recorder in December. The court action filed Jan. 7 attempts to force payment on the lien. The lawsuit also alleges breach of contract against the Dennis Group and unjust enrichment against both Smucker and Dennis.

This lawsuit, Colorado Designscapes Inc. v. JM Smucker LLC and The Dennis Engineering Group LLC, was filed in Weld County District Court as 2022cv30019.
