CDOT seeks condemnation of property to expand I-25

GREELEY — The Colorado Department of Transportation has filed two actions in Weld County District Court to assert its eminent-domain rights in connection with the expansion of Interstate 25 in Northern Colorado.

The actions involve adjacent properties at I-25 and Colorado Highway 60 (Johnstown exit) in the Gateway Center development west of the interstate.

The actions were filed Wednesday. In similar language, the court filings say the state has been unsuccessful in negotiating prices for property needed to expand the highway and asks the court to determine compensation for the landowners.

Two landowners are involved. An undeveloped parcel owned by BK NNN Properties LLC is listed to a Greeley address with Keirnes Cos. LLP as the registered agent. 

The other property, which is developed, is owned by Smith Acres LLC, a Colorado company, with Melissa Nicole Smith of Eaton listed as the registered agent. Also named in this suit are entities that may have tenant or easement interests in the property. They are Poudre Valley Electric Association Inc. and EG America LLC.

Attempts to contact owners of the properties were not successful as of publication time. 

CDOT did not respond to a request for information regarding how much of the properties are needed for the expansion.
