Boulder-based Kitchen Café sues Loveland’s Next Door Food and Drink
Boulder-based The Kitchen Café LLC has sued Loveland restaurant Next Door Food and Drink for trademark-infringement, alleging that its name and logo are too similar to The Kitchen’s restaurant concept, The Kitchen Next Door.
The Reporter-Herald reports that The Kitchen filed the suit Dec. 3 in Denver U.S. District Court, saying in its complaint that the owners of Loveland’s Next Door had refused to change its name despite being informed that it was causing confusion. The suit asks for injunctive relief and monetary damages.
The Kitchen, which in January raised a $9.5 million round of equity funding, operates seven restaurants in Colorado and one in Chicago. The company was co-founded by Kimbal Musk, brother of electric car maker Tesla and aerospace company SpaceX. The Kitchen opened its first restaurant in downtown Boulder in 2004, adding the Kitchen Upstairs in 2005. The first Kitchen Next Door opened in Boulder in 2011. Since then, the company has opened Next Doors in Glendale and Denver’s Union Station.
